GENERAL CONDITIONS OF SALE
Clause 1 - Introduction
This website www.iledetortuga.com (hereinafter referred to as the "website") is published by the self-employed company Nicolas BURRI for the Ile de Tortuga brand, registered with the Registry of the Commercial Court under the number SIRET (in progress) and whose head office is located at 61 rue Saint Martin 02400 Bonnesvalyn.
This document establishes the General Conditions of Sale. The conditions should be read carefully before using our website. By using the website or by placing an order, the customer accepts the General Conditions of Sale. The General Conditions of Sale are subject to change.
Article 2 - The customer
The customer declares, by placing an order on our website, to be a natural person aged at least eighteen years who has the legal capacity (or holder of parental authorization) to make payments on the internet.
Ile de Tortuga reserves the right to refuse to process an order (Cf. Article 6) if the recording of the Customer's personal data reveals questionable information, if the IP address of the customer of the order is different from the address billing/delivery or if the customer does not comply with the conditions given above.
In the event of an error in the recording of data, the customer must contact us directly via the following address: iledetortuga@gmail.com . Ile de Tortuga cannot be held responsible for the impossibility of delivering the order following a customer error.
Article 3 - Presentation of the product
All the characteristics of the products offered for sale are listed on the “Item Page” page in the “Store”. For more information, the customer can contact the Island of Tortuga at this address: iledetortuga@gmail.com .
Article 4 - Use of the product
The customer is responsible for his article and its use. Ile de Tortuga cannot be held responsible if: the article is passed through a machine such as a microwave, the article is left in an outdoor environment.
Article 5 - Product prices
The prices displayed on the Ile de Tortuga website are expressed in euros, but do not include delivery costs.
The company Ile de Tortuga reserves the right to modify these prices at any time. The items ordered are invoiced at the price displayed when the order is recorded.
Article 6 - Availability of products
Items are offered for sale while stocks last. In the event of an order for an unavailable product, we reserve the right to notify the customer by e-mail, as soon as possible. Replacement items of the same or higher price will be offered. If the customer refuses the replacement items, we undertake to reimburse any sum paid.
Article 7 - Order
The customer accesses the product pages from the store. He can then add the items he has selected to the basket. At the end of his selection, the customer confirms his order and proceeds to the payment of the basket. He then goes to the thank you page and an order confirmation email is sent to him.
Article 8 - Refusal to process an order
The Ile de Tortuga company reserves the right to refuse to process an order in the following cases: the unavailability of products (see Article 4) may oblige us not to deliver an order. If the customer does not meet the conditions of Article 2, we may refuse to deliver his order. Other exceptional circumstances may oblige us to refuse to deliver the orders, for example, cases of force majeure (Cf. Article 9). We reserve this right of refusal even after sending the order confirmation, at any time.
Article 9 - Methods of payment
The payment of the order is made by credit card only.

Bank details are secured by the host Stripe.
Article 10 - Exchange and return policy
10.1 Withdrawal period
The customer has fourteen working days, from receipt of his order, to exercise his right of withdrawal. To do so, we must receive an e-mail at iledetortuga@gmail.com or a postal letter at 61 rue Saint Martin 02400 Bonnesvalyn FRANCE, before the withdrawal period expires. If the withdrawal period expires on a Saturday, Sunday, public holiday or non-working day, the period extends to the next working day.
If items are returned, they must be sent back in their original packaging. Return costs are the responsibility of the customer. The return must be made by letter followed by the carrier La Poste at 61 rue Saint Martin 02400 Bonnesvalyn FRANCE, preferably in a bubble envelope or cardboard. The risks associated with the return of the items are the responsibility of the customer.
No refund will be made if: the returned item (not detected as defective on return) arrives defective, the returned item does not come back with its original packaging or if we notice a hygiene problem. The customer is responsible for the article when it is in his possession and when he handles it.
10.2 Return
If the items are not suitable, the customer has fourteen days to use his withdrawal period and return these items (without having to use a specific reason). If the withdrawal period expires on a Saturday, Sunday, public holiday or non-working day, the period extends to the next working day. Return costs are the responsibility of the customer; except, in the event that the product is defective, the return costs will be reimbursed (Cf. 8.4).
10.3 Exchange
If the items purchased are not suitable, the customer has fourteen days to request an exchange or a refund. Exchanged items will be sent upon receipt of returned items. Returned items are exchanged for items of the same amount. In the event that the exchanged items have a higher price than the returned items, the customer must pay the difference.
10.4 Defective Products
In the event that the product is defective, the customer must contact us directly via the following email address: iledetortuga@gmail.com . The customer must give us the characteristics of the article and the nature of the problem, we will then indicate the procedure to be followed. We will analyze the returned item and return our opinion by e-mail, the item can be refunded or exchanged according to the eligibility of the item and the customer's request. If we proceed to refund or exchange the item, this will be done within fourteen days from the sending of the e-mail of eligibility for one of the two processes mentioned above.
The refund will be the same as the method of payment made for your purchases. The refund will include return postage.
10.5 Return of personalized products
Personalized items are not affected by the right of withdrawal. According to Article L. 221-28 of the Consumer Code, "goods made to the consumer's specifications or clearly personalized are not affected by this right of withdrawal".
Article 11 - Delivery
The Ile de Tortuga company will endeavor to deliver the orders within the indicative time given when choosing the delivery of the order or, in any case, within thirty days from the order confirmation; except in the event of force majeure or in the event of unavailability of the products (see Article 4). Tortuga Island cannot be held responsible for delays or damage due to the carrier.
The article(s) is delivered by letter followed by the carrier La Poste; except in the event of a specific request from the customer. The customer can follow his order thanks to the tracking number. The delivery time generally observed for Metropolitan France is 48h/72h (working days). An order cannot be delivered on a Sunday, a public holiday or a non-working day. Delivery costs are always the responsibility of the customer.
The following cases of force majeure: war, riot, social movements and the impossibility of being supplied discharge the company Ile de Tortuga from its obligation to deliver.

Article 13 - Intellectual property
The customer acknowledges that all elements of the website: www.iledetortuga.com: articles, brands, models, logos, designs, photos, images, texts, comments, concept, packaging, sounds and videos are his property. Consequently, the customer refrains from any act of reproduction, downloading, copying or exploitation - even partial - for commercial or non-commercial purposes, worldwide.
Any act cited above and carried out in an unauthorized manner by Ile de Tortuga may be the subject of legal proceedings.
Article 14 - Settlement of disputes
In case of disputes, if the customer has any request or thinks that these rights have been violated, his complaint must be sent to the following address: iledetortuga@gmail.com in order to seek an amicable settlement.
In view of European Regulation No. 504/2013, the customer has the right to request the resolution of the dispute online via the following e-mail address: http://ec.europa.eu/consumers/odr/ .
Article 15 - Right to change policies
Ile de Tortuga reserves the right to modify these policies at any time. The orders will not be affected, the modifications will not be retroactive, except in the case where the change has been ordered by the competent authorities. In the event that the competent authorities request feedback on the modification, the orders will be affected and you will be notified of this change.
Article 16 - Applicable Law
All the clauses appearing in this document General Conditions of Sale as well as all the operations of purchase and sale will be subjected to the French laws.
If the delivery is planned in a country other than Metropolitan France, it is the duty of the customer to check whether the article complies with the legal legislation. Ile Tortuga cannot be held responsible if the item does not meet the standards of the country in question.
